Bavarian Gigabit Directive (BayGibitR)

The Bavarian Gigabit Directive (BayGibitR) specifically targets municipalities, municipal associations, and municipal entities in the Free State of Bavaria. The goal is to improve broadband supply in underserved areas, known as "grey and white NGA spots", by building gigabit-capable broadband networks.

The BayGibitR promotes the establishment of gigabit-capable broadband networks in Bavaria. This includes both closing the profitability gap for public network operators and the construction of proprietary passive broadband infrastructures by municipalities. Projects must result in a significant improvement in broadband supply.

The BayGibitR provides financial support in the form of non-repayable grants. The funding amount varies depending on the regional category and can be increased by a bonus for inter-municipal cooperation. There is both a minimum amount and maximum funding limits per municipality.

The funding is subject to specific conditions, including the existence of a "grey or white NGA spot" and the conduct of market and competitive procedures. Furthermore, open access conditions for the funded infrastructure and compliance with budgetary and European legal requirements are of central importance.

The application for funding must be submitted to the competent government before the conclusion of the contract with the network operator. Detailed documents are required, ranging from the resolution on the current supply to the results of the market and selection procedures.

The Bavarian Gigabit Directive (BayGibitR) is the primary legal basis for this funding program. It is supplemented by general budgetary provisions of the Free State of Bavaria and European legal requirements for state aid to ensure the correct and transparent implementation of the funding measures.
